The FMCSA announced that, rather than proceeding with an SNPRM as planned, it has withdrawn the proposed rule altogether. The agency appears to have withdrawn the proposal in light of various concerns raised in the hundreds of comments received to the docket. Notably, the FMCSA acknowledged that, before proceeding with any new rulemaking on the issue, it will first consider the results of the study that is currently underway by the National Academies of Science of the agency's SMS data and methodologies. According to the announcement, "[i]f FMCSA determines changes to the safety fitness determination process are still necessary and advisable in the future, a new rulemaking would be initiated that will incorporate any appropriate recommendations from the National Academies of Science and the comments received through this rulemaking."
