Gov. Bruce Rauner has signed SB 1871 into law, which makes major changes and clarifications to the Illinois Rolling Stock Sales Tax Exemption law as it applies to trucks, trailers and parts purchased in Illinois and used in interstate commerce. The bill was proposed and negotiated  solely by Mid-West Truckers Association and culminates many years of work to make the exemption fair and equitable to Illinois truck owners. SB 1871, the result of lengthy negotiations with the Ill. Dept. of Revenue (IDOR), will simplify the exemption requirements and removes the many 'dark holes' in the current regulation that has caused so many problems.  The current Rolling Stock rule was put into place in 2004 and was negotiated solely between MTA and IDOR.  At that time, the rule appeared to be pretty straightforward.  But over the years, IDOR's interpretation of those rules changed and many MTA members were getting hung up over what was considered a "trip" and what truly constituted an interstate movement. IDOR must now promulgate rules to reflect the changes made by the new law. Watch for an additional e-mail update tomorrow giving details of how the exemption will work.
