The containership terminal in San Juan is operating (with limited generator power) under significant restrictions and limitations. The situation remains fluid but, for the moment and unless otherwise directed by the terminal, Hapag-Lloyd intends to maintain its current schedule for vessels calling in/out of Puerto Rico. Among other things, it is understood that access to the terminal may be limited due to road and other conditions resulting from the Hurricane(s). In the event you do not want your cargo discharged in Puerto Rico as intended, please contact Hapag-Lloyd immediately with instructions. Hapag-Lloyd, without prejudice or guarantee, they will use best efforts to assist you in finding a reasonable alternative(s). However, please be advised that any and all costs, liabilities, charges, expenses, obligations, and damages of whatsoever kind and nature arising from, related to, or in connection with not discharging your cargo as scheduled shall be strictly for the Merchant’s account. Moreover, all terms of Hapag-Lloyd’s Bill of Lading or Sea Waybill shall remain in full force and effect at all times that the cargo remains in the care, custody and/or control of Hapag-Lloyd, its agents, representatives and contractors.
